PrepSmarter.ai is an online educational platform owned and operated by PrepSmarter LLC ('Company', 'PrepSmarter'), a limited liability corporation incorporated in the State of Delaware. The platform provides personalized SAT preparation services through an AI-powered learning system.

2. Agreement to Terms

By accessing or using the Website, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and PrepSmarter. This document is an electronic record published in accordance with applicable laws and does not require physical or digital signatures. The terms are to be read along with our Privacy Policy and any other policies on the website.

3. Eligibility and Account Registration

To use our services, you must:

Be at least 12 years of age
Create and maintain only one account
Provide accurate and complete registration information
Keep your account credentials secure and confidential

Name (first and last)
Email address
Mobile phone number
Demographic information (age, gender, address)
Basic information from social media accounts if you choose to link them

4. Services and Usage

5. Payment and Refund Policy

Our refund policy is designed to ensure your satisfaction with our service:

Refund Eligibility

You are eligible for a full refund if:

Your SAT score does not improve by at least 150 points after 6 weeks of practice
You have completed at least 80% of the assigned practice questions
You have maintained regular engagement with the platform (at least 3 sessions per week)

Refund Process

To request a refund:

Email your refund request to hello@prepsmarter.ai
Include both CollegeBoard score transcripts as attachments
Include your PrepSmarter account email address
Submit your request within 30 days of receiving your official SAT score results

All refund requests will be reviewed within 2 weeks. If approved, refunds will be processed using the original payment method within 10 business days. We reserve the right to verify the authenticity of score reports and account activity before processing any refund.

6. Intellectual Property Rights

All content on the Website, including but not limited to text, graphics, logos, images, software, and digital downloads, is the property of PrepSmarter or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute any content without permission
Use our trademarks or branding without written consent
Reverse engineer or attempt to extract source code
Remove any copyright or proprietary notices

7. User Content and Conduct

By submitting content to our platform, you grant us a non-exclusive, perpetual, worldwide license to use, modify, and display such content. You agree not to:

Submit false or misleading information
Violate any laws or third-party rights
Interfere with the proper functioning of the Website
Attempt to gain unauthorized access to any part of the service

8. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy. Your data is stored securely on Google Cloud and AWS servers. We do not share your personal information with third parties except as required by law or with your explicit consent.

9. Limitation of Liability

To the maximum extent permitted by law, PrepSmarter shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

10. Dispute Resolution

Any disputes shall be resolved through a two-step process:

Mediation: A neutral third party will attempt to resolve the dispute
Arbitration: If mediation fails, a three-member arbitration board will make a binding decision

The arbitration shall be held in Delaware, USA, and conducted in English. The arbitrator's award shall be final and binding on both parties.

11. Referral Program

Our referral program allows registered users to earn cash back when referred students subscribe to PrepSmarter packages. Both the referrer and referred student are eligible for cashback. PrepSmarter reserves the right to modify or terminate the program at any time without prior notice.
